Cerebral palsy medical negligence success stories
Judgement and interim payments secured for bilateral dystonic cerebral palsy
Our cerebral palsy solicitors acted for the family of a claimant with bilateral dystonic cerebral palsy, which the family believed was the result of negligence on the part of the midwife and doctors handing the claimant’s birth in June 2009.
The claimant was born via caesarean section after the mother was admitted to a hospital birthing unit 10 days after the expected due date. Abnormalities were found in the CTG monitoring, but there was a 90-minute delay before the caesarean was carried out.
The baby experienced birth asphyxia (where the supply of oxygen to the brain is cut off), resulting in brain damage and, ultimately, a diagnosis of bilateral dystonic cerebral palsy.
Our team represented the family in their claim against St George’s Healthcare NHS Trust. We secured a judgement against the defendant, meaning our client will receive interim payments to make sure all of their child’s immediate care needs are met with a final compensation amount to be agreed upon once the child is old enough for lifelong care needs to be assessed.
